Terms and Conditions
The following terms and conditions of sale apply to the Online Shop Wearunique.com at URL http://wearunique.com ("Online Shop") and to the orders and transactions related to the products available from the Online Shop (product/s).
During navigation of Wearunique Online Shop by the user, when e-mails are sent or data are exchanged, both parties communicate electronically, and you the customer accept that all agreements, notices, publications and other communications that are carried out electronically satisfy all legal requirements that such communications be made in writing.
Important: these conditions of sale do not affect your STATUTORY RIGHTS (and should not be read as such), which cannot be waived or limited by contract.
The Online Shop is owned by and operates on behalf of We'ar Unique S.r.l., Modena , 41121 Viale Monte Kosica 111, Italy, VAT registration no. IT03250800368, REA MO-371607 ("We'ar Unique" or "us" or "we", depending on the context), who is the seller of the Products.

2. Placing an order
In order to purchase a Product(s), you must first create a personal account on Wearunique Online Shop and register with a personal username and password.

3. Processing of orders
The customer accepts that every order represents an offer to purchase the Products listed in the order, as set out in these conditions of sale. All orders must then be accepted by Wearunique. We may choose not to accept your order for any reason.
Once your order has been received, we will send you an e-mail with the subject Confirmation - Order Received containing the order number and information related to the Products ordered.
The sending of this e-mail does not imply acceptance of the order on our part. Acceptance is given and the contract of sale is completed when the Products are despatched, at which point you will receive confirmation by e-mail with the subject Confirmation- Order Despatched.
Should you wish to change your order, you can do so at any time before we send the e-mail confirming despatch.
You can do this by contacting Customer Service using the appropriate form found in the My Account section.
Wearunique reserves the right to cancel your order at any time prior to your receipt of the Products. In the event that Wearunique would like to cancel the order after sending the e-mail confirming despatch, your payment will be refunded.
4. Prices, Shipment, Handling Costs and Taxes

Wearunique reserves the right, without responsibility or the need to provide prior notice, to definitively change, suspend or discontinue the availability of some Products.

Our aim is to deliver Products on time. However, for various reasons delivery could be delayed. Therefore, all delivery dates should be considered as indicative and not restrictive, as Wearunique cannot guarantee that the Product(s) will be delivered within the estimated dates. There may also be cases in which shipment is delayed, where it is not possible to despatch the Product on the expected date. In this case you will be contacted to set a new date.
In the case in which you, the customer, postpone the delivery of the products or delay receipt notwithstanding our estimated delivery, which we undertake to inform you of, we reserve the right to charge an amount which represents the additional costs sustained due to these actions or omissions.
If the Products are not delivered for a period of 10 working days, it will be deemed that you have exercised your right to terminate the contract and we will reimburse you, subtracting any additional costs incurred by Wearunique.
On delivery, Wearunique recommends that the customer checks the condition of the delivered items before signing the acknowledgement of receipt.
If the delivery is not as expected, the customer should refuse the delivery or express their reservations by adding the words “Subject to Verification” on the acknowledgement of receipt they sign for the courier.

Payment must be made using PayPal or credit cards approved by Wearunique belonging to the Mastercard, Visa or Visa Electron networks, including pre-paid cards (e.g. Poste Pay). It is also possible to pay by American Express through the PayPal secure payment system. Refer to the FAQ section for more information.
It should be noted that:
Wearunique retains ownership of the Products until it receives the full payment due for Products and until delivery is made. Wearunique (also through delegated third parties), reserves the right (subject to applicable legislation) to sell or handle the Products, and to take action to regain possession of the Products should payment not be received, or if the credit card issuer does not authorise payment or requests Wearunique, for whatever reason, to reimburse a payment which has already been made.
8. Returns and Refunds
If you would like to exercise your right to withdraw from the contract, you must contact We’ar Unique S.r.l. within 14 days from the date of receipt of the goods. The request is made by filling in the appropriate form in the My Returns section on the My Account page. To access the form, users need to login using their username and password.
Should you have difficulty in using the form, contact Customer Service by using the Contact Us form.
In compliance with article 64 of the Italian legislative decree n. 206 of 6 September 2005 ("Consumer code, in accordance with article 7 of the Italian law no. 229 of 29 July 2003"), any customer that exercises his/her RIGHT TO WITHDRAW has the right to return the product received without payment of any penalty and without giving any reason for the return, within a maximum of 14 days from the date of withdrawal. This term is respected if the customer sends the goods back before the end of the 14 day period following delivery. The conditions set out in Section 10 will also be applied.
9. Supply of incorrect, incomplete or defective products

Following the initial notification, and no more than 8 days later, your claim should be documented, sending us all the information concerning the shipment and the loss, damage or delay.
The consignment will be considered as being in good condition unless the recipient has specifically noted damaged or missing items on our delivery document at the moment of delivery of the consignment. In order for a claim for damage to be considered, the contents of the shipment and the original packaging must be made available to us for inspection.
If we accept all or part of your claim, you must warrant that your insurers or any third parties with an interest in the shipment will waive any rights, remedies or relief to which they might become entitled by subrogation or otherwise.
In such cases, we will collect the Products and, depending on the individual case, send a replacement shipment or provide a refund.
The conditions set out in Section 10 will also be applied.
Once the permitted period for the customer to exercise their right to withdraw has expired, the customer may raise objections and/or actions for defective goods and/or in relation to guarantees, to the manufacturer only. Whenever the details of the manufacturer are not indicated clearly on the product, do not hesitate to contact We'ar Unique S.r.l. Customer Service using the appropriate form found in the My Account section.
10. How to return products
To organise returns, create a Return Request by clicking on My Returns and selecting the order and items that you want to return.

We ask you to handle the products with care and to return them in the condition in which you received them at the time of delivery.
The goods should be sent back to We'ar Unique S.r.l. by whatever means the customer considers most appropriate, to - viale IV Novembre, 20 - 41123 - Modena, Italy. All costs for returning the goods are the sole responsibility of the customer, including any customs duties and taxes which We’ar Unique S.r.l. is required to pay to re-import the goods returned by the customer. No objections can be raised by the customer to We'ar Unique S.r.l. for additional costs incurred by the customer when returning a product.
If you return products:
If, on the other hand the return is accepted by Wearunique, we will reimburse you with the price you paid by crediting your payment card.
Any amount due to Wearunique will be subtracted from the refund.
Wearunique accepts returns only for products purchased on Wearunique Online Shop.
As a Wearunique customer you must accept that the total amount of the order will be returned without interest by crediting your current account or credit card within a maximum of 7 days starting from the moment in which the return of the goods was carried out.
We will make every effort to fulfil our obligations. However, we cannot be held responsible for delays or non-fulfilment if these are caused by circumstances beyond our control. In the case of delays, we will endeavour to provide the service as soon as is reasonably possible.
11. Responsibility
These Conditions of Sale set out all our obligations and responsibilities regarding the supply of Products. There are no other warranties, conditions or terms that are binding on us.
Any warranties, conditions or other terms relating to the transaction which might be implied by the applicable laws in the country in which you purchased the Products (including and without limitation any implied term as to quality, fitness for purpose, reasonable care and skill) are hereby excluded to the maximum extent permitted by law. In particular, Wearunique does not assume responsibility for ensuring that the Products are suitable for your purposes.
Wearunique is not contractually responsible for civil tort or for any economic loss (including, but not limited to, loss of income, loss of profit, loss of contracts, loss of business or anticipated savings), loss of data, loss of reputation or for any other loss or special, direct, non-contractual or punitive damage, of any type and in whatever way it may arise.
In any event, nothing in this section limits your statutory rights and nothing in these conditions of sale attempt to exclude or limit the responsibility for:
By adhering to these Conditions of Sale, you agree to abide by all regulations, laws and legal orders of the European Union and the Italian Republic relating to export, re-export, transfer or resale of Products ("Export Laws") and accordingly, you agree not to export any products to countries in breach of Export Laws, and not to export any Product to countries for which licences to export are required or other government approval, without first obtaining all the necessary licences and approvals. You guarantee that you are not located in, under the control of, or a citizen or resident of any country to which export of Products is prohibited by the relevant Export Laws.
13. General considerations
If any part of these conditions of sale is deemed invalid, illegal or unenforceable, that condition shall be applied to the maximum extent allowed by the law, and the validity, legality and enforceability of other provisions shall not be affected.

- Only apply to purchases made through Wearunique Online Shop and can be modified and/or updated at any time by Wearunique. All changes to the conditions of sale will be applied to orders made after these changes have been implemented.

2. Placing an order
In order to purchase a Product(s), you must first create a personal account on Wearunique Online Shop and register with a personal username and password.
Remember to keep this information secret as all transactions carried out using your access data will be your sole responsibility. In order to make a purchase, you must:
- Insert your full name, correct address, telephone number, payment details and any other necessary information.
- Be at least 18 years old.
- Supply a valid delivery address (remember that deliveries cannot be made to PO boxes, hotels or hostels).
- Use a valid credit card.
- Go to the product details.
- Click on the "Add to basket" icon
- By clicking on the "My Basket" link, the user will be taken to the Shopping Basket page where it will be possible to complete the order and view the items selected. On this page it is possible to modify quantities or remove products, and insert promotional codes should you have any.
- At this point the purchase can be completed by clicking on "Proceed to Checkout" and the product(s) will be despatched to the delivery address provided.

4. Prices, Shipment, Handling Costs and Taxes
Remember that:
- The price to be paid for a Product is the price shown at the time the order is placed, and which can be found in both the Order Confirmation and Order Shipment Notice e-mails.
- Wearunique can change prices without notice and at any time.
- Product prices do not include delivery charges, handling costs and applicable taxes (except for VAT, which is included in the price). Export custom charges are included in the price. Any import custom fees will be charged when the package reaches its destination, and the costs are borne entirely by the recipient. For further information it is advisable to contact the appropriate customs authority in the destination country.
- For products shipped outside the EU, customs charges may be applied according to the laws in force in the destination country. The full costs for the permanent importation of the goods (VAT, duties, etc.) and the related customs procedures are entirely borne by the customer. If the recipient and/or customer refuses to pay the charges and expenses for the permanent importation of the goods required under the laws in force in the destination country, three days following the request for initial payment by the shipper/courier, the package may be:
- abandoned. In this case, the customer will not be entitled to any reimbursement;
- returned to the sender. In this case, the customer will remain entirely and solely liable for: delivery costs, costs relating to customs procedures already incurred in the destination country, costs for returning the goods to the sender, any costs for customs procedures relating to the re-importation of the goods, and any additional management costs requested by the courier. The customer will be reimbursed the amount paid for his/her order after the deduction of all the costs indicated above.
- Wearunique recommends that the shipping address specified in the order is one where there is always someone available to receive the delivery. If this is not the case, then we suggest that the goods are delivered to the recipient's workplace in order to avoid delays in delivery.
- It is only possible to specify one shipping address. It is not possible to specify "additional" addresses that the goods can be delivered to in the case that the recipient is absent and/or cannot be contacted. For example, it is not possible to specify, "if not at home, deliver to Mr. John Smith" or "if not at home, deliver to London Street Grocery"
- Any administrative and storage costs resulting from the failure to deliver an order (caused by factors beyond the control of We'Ar Unique Srl) will be payable by the recipient. Delivery, storage and/or return costs will be charged to the purchaser in the following cases: if the purchaser specifies an incomplete or inaccurate address during the order process, if the purchaser refuses the package, if the purchaser cannot be contacted for four days from shipment and/or a delivery attempt is made by the courier and/or the goods are not picked up within 5 days of the “held for collection” notification provided by the courier and/or the goods are not collected within 5 days from the Parcel Shop (GLS Parcel Shop or TNT Point or UPS Access Point) the items were delivered to (in the case where direct delivery to the customer was not possible).
- Delivery will be made at the address specified by the customer at the time of ordering. If the delivery address changes after the order has been shipped, this can be requested only on payment of any supplementary costs incurred by We'ar Unique Srl for this service.
5. Availability of products and delivery
Wearunique reserves the right, without responsibility or the need to provide prior notice, to definitively change, suspend or discontinue the availability of some Products.

Our aim is to deliver Products on time. However, for various reasons delivery could be delayed. If the delivery is not as expected, the customer should refuse the delivery or express their reservations by adding the words “Subject to Verification” on the acknowledgement of receipt they sign for the courier.
Once the goods have been received, check within 3 days from delivery that:
- The packaging is intact
- The contents of the package are complete
6. Payment
Payment must be made using PayPal or credit cards approved by Wearunique belonging to the Mastercard, Visa or Visa Electron networks, including pre-paid cards (e.g. Poste Pay). It should be noted that:
- Credit card details must be provided at the time of ordering.
- Your credit card will be debited at the moment of purchase of the Products.
- The Products will not be sent to you in the event that your credit card issuer does not authorise payment.
- You should retain the e-mail confirming despatch of the order, which is a valid proof of purchase.

10. How to return products

Some useful information is outlined below:

- User manual, if provided.
- Any products or free gifts received with the order.
- Every product or the entire contents of a package if the product was purchased together with others.
We ask you to handle the products with care and to return them in the condition in which you received them at the time of delivery.
The goods should be sent back to We'ar Unique S.r.l. by whatever means the customer considers most appropriate, to - viale IV Novembre, 20 - 41123 - Modena, Italy. All costs for returning the goods are the sole responsibility of the customer, including any customs duties and taxes which We’ar Unique S.r.l. is required to pay to re-import the goods returned by the customer. No objections can be raised by the customer to We'ar Unique S.r.l. for additional costs incurred by the customer when returning a product.
If you return products:
- Which cannot be returned
- Which are not found in their original condition
- Which are not packaged appropriately or not at all
- Which have one or more parts missing that were present originally
- Where sufficient care has not been given to preserve the condition of the products and to organise their return
- Which are not part of a previously authorised Return Request
If, on the other hand the return is accepted by Wearunique, we will reimburse you with the price you paid by crediting your payment card.
Any amount due to Wearunique will be subtracted from the refund.
Wearunique accepts returns only for products purchased on Wearunique Online Shop.
